What Is Changing — The Core of the Amendment Effective January 8, 2027
The amended Waste Management Act, promulgated on July 7, 2026, takes effect on January 8, 2027. For SME manufacturers, the provision to watch is the one that tightens control over waste treatment data. It creates a new basis for an administrative fine of up to KRW 1 million when waste treatment site data is not entered within the prescribed period or is entered inadequately.
Until now, sanctions focused on failing to enter transfer and receipt records at all, or entering false ones. From next year, late entry and inadequate entry become separate grounds for a fine.
Two layers need to be kept apart.
Who Must Enter the Data — Generators, Transporters and Treatment Operators
Article 18(3) of the Act requires anyone who generates, collects and transports, recycles or disposes of industrial waste designated by ministerial ordinance to enter the transfer and receipt details and the waste treatment site data into the electronic system (Allbaro) each time. Site data means weighing values, location data and video data.
The site data transmission scheme was phased in for construction waste in October 2022, designated (hazardous) waste in October 2023, and general industrial waste in October 2024. The burden of installing weighing and video equipment and transmitting the data falls mainly on transporters and treatment operators. Even so, the wording of the Act includes generators, so sites that treat or haul their own waste should check the Act and the Enforcement Rule to see whether they are covered by the site data obligation.
Not being the direct obligor does not remove the risk. A generator must verify a contractor's treatment capacity before outsourcing, and may be subject to a corrective order if the outsourced waste is handled improperly. Repeated delays and errors by a contractor will also diverge from the generator's own transfer records, which is what draws an inspector's attention.
Where SME Manufacturing Sites Commonly Slip
Designated waste is subject to stricter rules, including treatment plan confirmation and storage time limits, so it is best audited separately from general industrial waste.
A Three-Month Roadmap Before the Effective Date
October–November: Audit Your Own Entry History
Download the past year of Allbaro transfer and receipt records. Compare the gap between removal date and entry date, the difference between generated and treated quantities, and the waste codes. Sort the errors into three types — delay, quantity and classification — and count each.
November–December: Check Contractors and Tighten Contracts
Confirm each transporter's and treatment operator's permitted waste types, treatment capacity and the working condition of their site data transmission equipment. Add contract clauses on meeting entry deadlines, notifying errors and allocating responsibility for violations.
December to the Effective Date: Fix Internal Procedures
Write same-day entry into the procedure, then designate and train a primary officer and a backup. This is also the point to reflect the finalized fine criteria in the Enforcement Decree.
Managing It Within ISO 14001 and Compliance Evaluation
Companies running ISO 14001 do not need a separate workflow. Add the amended provision and its effective date to the legal register, and add "timeliness and accuracy of Allbaro entries" to the compliance evaluation items.
The resulting records also serve as evidence for customer ESG assessments. Supply chain ESG reviews of waste management mainly ask for proof of lawful treatment, contractor oversight and waste volume data.
Working with KITIM
A fine of KRW 1 million is modest in amount. A violation history, however, becomes a record that local government inspections and customer assessments return to repeatedly. KITIM supports environmental compliance diagnostics, ISO 14001 implementation and maintenance, and supply chain ESG assessment response together. If you would like to review your waste management system before the amendment takes effect, please reach out through KITIM's consultation request.
