New 'Semi-Innovative Pharmaceutical Company' Certification — 7% R&D / KRW 5bn Thresholds, Generic Price Incentives, and What SME Pharma Firms Must Prepare Now

Korea's September 2026 pharmaceutical certification reform introduces a new "Semi-Innovative (Leap tier)" designation. Firms under KRW 100bn in revenue must meet both a 7% R&D intensity and a KRW 5bn minimum investment, with preferential generic drug pricing as the headline benefit. Here is a four-week self-assessment roadmap to prepare for the application round planned by December.

Under the pharmaceutical certification reform direction announced by the Ministry of Health and Welfare on September 2, 2026, the government plans to split the framework in two: the existing Innovative Pharmaceutical Company designation becomes the "Leading" tier, while the newly created Semi-Innovative designation becomes the "Leap" tier. The intent is a staged growth pathway running from startup → Leap tier → Leading tier → global pharmaceutical company.

Detailed rules are still under discussion at the public-private pharmaceutical industry council launched on September 2, with the government aiming to set the legal basis by November and take new applications by December. The figures in this article therefore reflect the draft disclosed to date and are not yet final. That said, the basic structure of the requirements is unlikely to shift dramatically, so starting preparation now is the reasonable call.

One point deserves particular attention: requirements for the existing Innovative certification are moving in the opposite direction — they are being tightened. For small and mid-sized pharmaceutical firms that have been sitting just below the threshold, this creates a lowered door and a raised door at the same time. If your company has been targeting the Innovative certification, now is the moment to decide whether to reset that target to the Leap tier instead.

Designation Requirements: R&D Intensity by Revenue Bracket Is Everything

The draft requirements are straightforward. Companies are sorted into brackets based on average pharmaceutical revenue over the preceding three years, and R&D investment intensity is assessed per bracket.

  • Revenue under KRW 100bn: R&D intensity of 7% or higher AND minimum investment of KRW 5bn or higher — both must be met
  • Revenue of KRW 100bn or higher: R&D intensity of 5% or higher
  • KRW 100bn or higher with US/EU GMP conformity: relaxed to 3% or higher
  • There is an easy trap here. Companies in the sub-KRW 100bn bracket must satisfy the ratio and the absolute amount simultaneously. For a firm with KRW 50bn in annual revenue, 7% works out to KRW 3.5bn — but the KRW 5bn floor is higher, so the effective standard is KRW 5bn, or 10% of revenue. Conversely, a firm at KRW 90bn faces a 7% requirement of KRW 6.3bn, making the ratio the binding constraint. The smaller the revenue base, the heavier the absolute-amount requirement weighs.

    Two operational points also need checking. First, the designation is valid for three years, and falling below the standard during that period results in revocation. This is not a one-year spending push — it presumes a financial plan that sustains the investment level across three years. Second, the process is designed to verify only basic eligibility without separate detailed review documentation, which makes the application burden substantially lighter than the Innovative certification.

    Disqualification criteria are also worth noting. Discussions point toward excluding violations that occurred more than five years before the review date, which opens a re-entry path for companies that abandoned the Innovative certification entirely because of past rebate infractions.

    The Real Prize Is Generic Drug Pricing — A Revenue Issue, Not a Certification Issue

    The main benefits currently on the table are preferential pricing for generic drugs and bonus points in government R&D programs. Of the two, the practical weight sits squarely on pricing.

    The higher a small or mid-sized pharma company's generic revenue share, the more directly certification status flows through to product-level profitability. When a KRW 50bn-revenue firm raises R&D spending to roughly KRW 5bn per year to secure Leap-tier designation, that outlay should not be booked mentally as a simple expense — it functions as a defense mechanism for the pricing of the entire generic portfolio. This is the moment to reframe R&D investment from a cost line into a price-protection instrument.

    That said, do not overreach. The broader trend of price reductions continues regardless, so never assume certification alone will protect margins. Pair certification preparation with a hard review of your product portfolio. Increasing R&D spending without clearing out low-margin products will break your cash flow first.

    Where Does Your Company Stand? A Four-Week Self-Assessment Roadmap

    Even before the detailed rules are published, you can determine your position now.

    Week 1: Recompile Three Years of Figures

    Reassemble pharmaceutical revenue and R&D expenditure for the preceding three years on a consistent accounting basis. In particular, clarify the treatment of ordinary R&D expenses, capitalized development costs, and contracted research expenditure. Whether capitalized development costs are counted as R&D investment commonly shifts the resulting ratio by 1–2 percentage points.

    Week 2: Determine Your Bracket and Calculate the Gap

    Establish your revenue bracket, then calculate the shortfall against the target ratio (7% / 5% / 3%). If you fall under KRW 100bn, confirm carefully that the effective standard is whichever is higher — the ratio or the KRW 5bn floor.

    Week 3: Evaluate Ways to Close the Gap

    If internal funds alone cannot cover the shortfall, government R&D matching programs are the lever. Selection for programs such as the Korea Drug Development Fund projects or the pharma-bio venture collaborative technology development program raises your own investment through required matching contributions, letting you meet certification requirements and execute the project at the same time.

    Week 4: Check Your GMP Status

    Verify whether you hold US or EU GMP conformity. For companies above KRW 100bn in revenue, GMP certification lowers the R&D requirement from 5% to 3% — for a firm at KRW 150bn, that is roughly KRW 3bn less in annual R&D obligation. Compare which is cheaper for your company: the GMP investment or the additional R&D spend.
